Terms

Purchase / Purchased The purchase of a Museum Pass via the Website, the purchase of a Temporary Museum Pass or the redemption of a Gift Museum Pass.

Gift Museum Pass A one-time, transferable code assigned to a natural person. By redeeming this code, the recipient can purchase a Museum Pass.

Terms of Use These Terms of Use.

Information The information available on the Website regarding the purchase and use of the Museum Pass.

Cardholder The natural person in whose name the Museum Pass is registered.

Customer Service The Customer Service of Stichting Museumkaart, reachable via the phone number: 0900-4040910 or through this contact form.

Museum A Museum that is a member of – or an affiliated institution admitted to – the Museum Association, and is partnered with Stichting Museumkaart, thus authorized to sell and accept the Museum Pass.

Museum Pass (or Pass) The proof of entitlement (in the form of a plastic or digital card) with which the Cardholder has certain rights and obligations, as further outlined in these Terms of Use.

Museum Pass App The application developed and offered by the Museum Association for use on a smartphone or other mobile device, which enables the activation and use of the digital Museum Pass. For the sake of readability, both the Museum Pass (the Pass) and the Museum Pass App are collectively referred to as the Museum Pass (or Pass), unless a specific distinction must be made.

Personal Data All information that identifies the Cardholder as an individual and and is used for registration on the Website or in the Museum Pass App (via the “Order,” “Register,” or “My Museum Pass” pages), such as name, address, city of residence, email address, date of birth, profile photo, (if applicable) bank account number, and similar data, all as defined in Article 4(1) of the General Data Protection Regulation (GDPR).

Privacy Policy The policy established and implemented by SMK concerning the processing of Personal Data, as outlined in the most current version of the privacy statement as published on the Website.

SMK Stichting Museumkaart, the legal entity appointed by the Museum Association to manage and operate the Museum Pass, with its office located at Piet Heinkade 181F, 1019 HC Amsterdam (P.O. Box 2975, 1000 CZ Amsterdam).

Temporary Museum Pass A Museum Pass purchased by the Cardholder at a Museum’s ticket desk, valid for 31 days and allowing a maximum of five museum visits.

Regulations The visitor rules established by each individual Museum, such as house rules, camera use policies, and similar guidelines.

Website The website of Stichting Museumkaart, accessible via https://www.museum.nl/en/museumpass, where one can purchase a Museum Pass, create a personal account via “My Museum Pass,” register or redeem a Museum Pass, and find further Information about using the Museum Pass.
Article 2
Agreement and Terms of Use

These Terms of Use apply to the agreement between the Cardholder and SMK. This agreement is established through the Purchase of the Museumkaart, as further described in Article 3 of these Terms of Use.

The agreement has a duration of either 31 days (Temporary Museumkaart) or one year, with the start date as further specified in Article 3. If the Cardholder has opted for automatic renewal via direct debit when purchasing the card, the agreement remains valid until terminated by either party.

The most recent version of the Terms of Use can always be consulted on the Website. Upon request, the Cardholder may receive these Terms of Use by email or regular mail. The Cardholder can contact Customer Service for this purpose.

The Terms of Use apply to the use of the Museumkaart. By using the Museumkaart, the Cardholder accepts the applicability of the Terms of Use. A Cardholder who does not wish to accept these Terms of Use must refrain from using the Museumkaart.

In addition to the Terms of Use, SMK publishes Information on the Website regarding the Purchase and use of the Museumkaart, as well as other guidelines and instructions relating to the Museumkaart. This Information also applies to the use of the Museumkaart (in the broadest sense). In case of conflict between the content of these Terms of Use and the Information, the Terms of Use shall prevail.

SMK reserves the right to unilaterally amend the Terms of Use and the Information. Any such amendments will be announced on the Website and, if applicable, in 'Museumtips'. The Cardholder has the right to reject the applicability of the amended Terms of Use and Information by ceasing to use the Museumkaart or by notifying Customer Service.

The Terms of Use also apply to the Museumkaart for Kids (the “Kidskaart”), which is the Museumkaart for children up to and including 12 years old. If children create their own profile on the Website (a “Museumkids Profile”), the 'Terms of Use for Museumkids Profiles' as published on the Website shall apply. These Terms of Use for Museumkids Profiles are expressly intended as supplementary to these Terms of Use.

The applicability of other terms and conditions, under any designation and from any party, is expressly rejected. However, this does not affect the applicability of any Museum-specific Regulations.
Article 3
Purchase and registration

The Museum Pass can be purchased in the following ways: a) at the ticket desk of a Museum authorized to sell the Museum Pass (a Temporary Museum Pass – see paragraph 2); b) online via the Website or the Museum Pass app (see paragraph 3); c) by redeeming a Gift Museum Pass (see paragraph 4).

A Temporary Museum Pass purchased at a Museum counter is valid for 31 days, starting from the date of purchase. This Temporary Museum Pass allows a maximum of five museum visits during this period, with the purchase itself counting as one visit, even if the Cardholder does not enter the museum. To extend the validity of the Temporary Museum Pass to one year, the Cardholder must register it on the Website (via the “Register your Museum Pass” page or through “My Museum Pass”). However, the original date of purchase remains the start of the validity period. The physical Museum Pass is sent by post to the address provided by the Cardholder. Once received, there is no longer a limit on the number of museum visits.

A Museum Pass purchased via the Website or the Museum Pass app is obtained by completing the required fields (under “Order” or “My Museum Pass”). During registration, the Cardholder can choose either a physical Pass (plastic pass) or a digital Pass. A Museum Pass purchased via the Website is valid for one year, starting from the day it is sent —or, in the case of a digital Pass, from the day it is activated.

Purchasing a Museum Pass using a Gift Museum Pass involves registering the unique code provided with the Gift Museum Pass, in accordance with the relevant information on the Website. This code is valid for 24 months from the date of purchase of the Gift Museum Pass and can only be used once. The Museum Pass obtained this way becomes valid from the date the code is registered (redeemed) or activated.

When purchasing a Museum Pass or Gift Museum Pass via the Website, as referred to in paragraph 1 under b and c, the individual making the purchase has a 14-day cooling-off period, starting from the day they receive electronic confirmation of the purchase, during which they may cancel the agreement by completing and submitting the designated PDF form (see link below). If the Cardholder has already used the Museum Pass to visit a museum during the statutory cooling-off period, the number of visits will be deducted from the purchase price of the Museum Pass. The reimbursement will be calculated based on the weighted average entrance fee of the participating Museums, as estimated for the year in which the Pass was purchased.

When purchasing via the Website, the Cardholder must enter their initials, last name, and date of birth, upload a profile photo, and provide a residential address in the Netherlands or in another European Union member state. The Cardholder guarantees that the data provided for registration is current, accurate, and complete. SMK reserves the right to block the validity of the Museum Pass if it appears that the provided information is not up-to-date, correct, or complete.

SMK will timely notify the Cardholder of the expiry of their current Museum Card, along with information on how to purchase a new one. If the Cardholder has expressly agreed to enter into a new agreement as referred to in Article 2, paragraph 2 of these Terms of Use, the validity of the Museum Pass will be extended by one year after payment has been made.
Article 4
Use Museum Pass

The use of the Museum Pass is strictly personal and non-transferable. The Pass remains the property of SMK.

The Museum Pass entitles the Cardholder to access the Museum during regular opening hours as published on the Museum’s website, as well as to benefit from offers for Cardholders. These offers are published on the Website by SMK or the museum. The Website does not claim to be exhaustive or fully accurate in this regard.

Access to the Museum is only granted upon presentation of the original Museum Pass or a current and functioning digital version of the Museum Pass in the Museum Pass app on a mobile device. A Cardholder in possession of a valid Museum Pass but unable to present it at the time of visit—regardless of the reason—shall not be granted access. Copies or (other, digital or otherwise) images of the Museum Pass will not be accepted. Upon using the Pass, the Cardholder may also be required to present identification for additional verification.

The Cardholder is responsible for checking in advance whether the Museum Pass is valid for the specific museum they intend to visit.

In the event of loss or theft of the Museum Pass, the Cardholder is entitled to a duplicate, provided they have registered their Pass. A fee will be charged for the duplicate. Duplicates are not available for Temporary Museum Passes or Gift Museum Passes.

A Museum may occasionally charge the Cardholder an additional fee for access during regular opening hours. Such a fee may only be charged during a period in which the Museum is hosting a special, temporary exhibition that, due to its (inter)national significance, entails exceptionally high exhibition costs — on the condition that the fee is charged to all paying visitors and the fee complies with agreements made with SMK. A “special, temporary exhibition” refers to an exhibition that is not part of the (semi-)permanent or fixed collection of the Museum and that entails demonstrably high costs for insurance, transportation, and display.

The Cardholder may subscribe to “Museumtips,” the digital newsletter for Cardholders, which includes offers and news about activities from SMK and the Museums. Subscription and unsubscription can be managed during registration or ordering, via the unsubscribe link at the bottom of the Museumtips email, on the Mijn Museumkaart website, or through Customer Service.

The Cardholder acknowledges and understands that a Museum may apply its own regulations, in addition to the Terms of Use and Information related to the Museumkaart, which visitors must respect. In case of conflict between the Information provided by SMK on the Website and/or in Museumtips and the Museum's own regulations, the Museum’s regulations shall prevail. If compliance with these regulations involves (additional) processing of personal data, the privacy policy of the relevant Museum applies. SMK is not involved in this process.

The Cardholder agrees to use the Museum Pass solely for its intended — personal — purpose. It is not permitted to lend the Card to third parties, make copies of it, offer it for sale, or otherwise exploit or misuse it. Additionally, the Cardholder may not claim any rights from the Museum Pass other than those explicitly granted by SMK. In cases of improper conduct by the Cardholder, the Museum reserves the right to deny entry. SMK may subsequently block the Museum Pass, either temporarily or permanently.

In cases of doubt regarding the validity of the Pass or the identity of the Cardholder, the Museum may deny free access or associated offers linked to the Museum Pass.

SMK is not liable for any damage arising from differences in admission fees or opening hours of a Museum, or from misuse or improper conduct by the Cardholder.
Article 5
Prices and payments

The price of the Museum Pass is always for a one-year period, including in the case of a Temporary Museum Pass or a Gift Museum Pass. The purchase price of the Museum Pass must be paid either directly at the ticket desk or via the Website through electronic payment (with or without using the provided QR code), or by direct debit as described in paragraph 2. Additional costs may apply for registration of the Museum Pass to a residential address in another European Union member state outside the Netherlands. When purchased via the Website, the Pass will be delivered within five working days after payment has been received.

The Cardholder may choose to authorize SMK to collect payment via direct debit, in accordance with the Information provided on the Website. By opting for direct debit, the Cardholder agrees to the (tacit) renewal of the Museum Pass, until cancellation. The Cardholder may cancel the agreement subject to direct debit at any time by deselecting the direct debit option under payment details in their My Museum Pass account, or by withdrawing the authorization with their bank. A one-month notice period applies to such cancellation. SMK will refund the remaining amount of the current Museum Pass(es), minus one month calculated from the day of cancellation, to the bank account known to SMK.

SMK reserves the right to unilaterally change the prices of the Museum Pass or to offer discounts on services and products linked to the Pass. Any price changes will not apply to ongoing agreements.
Article 6
Personal data and confidentiality

For the purpose of its services, the Museum Pass Foundation (SMK) processes the Cardholder’s Personal Data, such as name and address details, profile photo, and bank account numbers for payment purposes. If the Cardholder has opted for direct debit, the processing of personal data necessary for executing the authorization is included.

If any changes occur in the Cardholder’s Personal Data, the Cardholder must update these details as soon as possible in their Museum Pass account or notify the Customer Service.

Regarding the processing of Cardholders’ Personal Data, SMK has established a Privacy Policy, which is published on the Website (see: www.museum.nl/nl/privacy) and forms an integral part of these Terms of Use. The Privacy Policy specifies the purpose and legal grounds for processing Personal Data. It also explains how data subjects can exercise their rights. SMK's Privacy Policy is evaluated from time to time and revised when necessary. Any changes will be announced on the Website.

For children up to and including the age of 12 who hold a Kids Pass, a supplemental privacy policy applies, which can be found at https://www.museum.nl/nl/museumkids/privacyverklaring-museumkids).

SMK’s Privacy Policy includes the use of cookies on the Website, as described in the Cookie Policy (see: www.museum.nl/nl/cookies).

SMK only informs Cardholders about offers regarding products and services from SMK and Museums, or from sponsors and third parties, if they have subscribed to these communications. The Cardholder’s interests are taken into account as much as possible. Cardholders can unsubscribe from promotional mailings at any time—via the unsubscribe link in the email, in “My Museum Pass” on the Website, or by notifying Customer Service.

In addition to the data and data processing mentioned in this article, all contact between the Cardholder and Customer Service is regarded as confidential by SMK. SMK will not use this information for any purposes other than those explicitly stated.
Article 7
Blocking and unblocking the Museum Card

The SMK shall or may block (the validity of) the Museum Pass in the following cases:
a. if the holder of a Temporary Museum Pass has not registered within 31 days and/or has reached the maximum of five museum visits, all as referred to in Article 3, paragraph 2 of these Terms of Use. SMK will unblock the Museum Pass once the Cardholder has completed the registration via the Website (through “Register your Museum Pass” or “My Museum Pass”) and the physical Pass has been sent. The date of purchase of the Temporary Museum Pass shall, however, remain decisive for the validity period, also after unblocking.
b. if it becomes apparent to SMK that the Cardholder has made improper use of the Museum Pass and/or has behaved contrary to the Rules of a Museum. Unblocking of the Pass will only take place upon a substantiated request from the Cardholder. However, SMK reserves the right to reject such a request. -
The cases mentioned in paragraph 1 of this Article are not exhaustive. SMK reserves the right to also block the Museum Pass in other (comparable) situations. Any blocking of a Museum Pass under this Article will be accompanied by a statement of reasons.
Article 8
Termination of Use
- The right to use the Museum Pass ends:
a. upon expiration of the validity period of the Museum Pass;
b. in the case of a Temporary Museum Pass: upon expiration of the validity period (31 days) or upon reaching the allowed maximum of five museum visits, whichever comes first, until the Cardholder has registered the Temporary Museum Pass;
c. through revocation of the agreement by the Cardholder, as referred to in Article 3, paragraph 5;
d. through withdrawal of the authorization for automatic debit, as referred to in Article 5, paragraph 2. The Museum Pass remains valid until one month after the date of withdrawal of the authorization;
e. upon termination of the agreement by SMK. If the Cardholder fails to fulfill their obligations under the agreement or these Terms of Use, SMK is entitled to terminate the agreement – after notice of default – without any obligation to pay compensation.
Article 9
Other provisions
- All legal relationships concerning the Museum Pass are governed by Dutch law. Any disputes will be submitted to the competent court in Amsterdam.
- Terms that deviate from these Terms of Use are only valid if they are set in writing and signed by both parties as agreed.
- If one or more provisions of these Terms of Use are found to be unlawful or invalid for any reason, this will not affect the validity of the remaining provisions.
- These Terms of Use came into effect on January 15, 2016, and were last updated on October 29, 2024. They may be referred to as "Terms of Use for Museum Pass Holders."
